1. General Provisions.

2. Terms.
A game is an activity aimed at satisfying human needs for entertainment, pleasure, stress relief, and the development of certain skills and abilities in the form of free self-expression that are not associated with achieving utilitarian goals and bring joy in themselves. A gaming platform is a hardware and software system consisting of physical devices and software located on the global Internet, designed to organize leisure and recreation. OVER GEMS , the online economic game "Virtual Online Money" is a separate and unique name for a gaming platform owned by the organizer and located at the Internet address https://overgems.fun, where the Organizer provides the participant with services for organizing their entertainment, leisure, and recreation in the manner and under the terms set forth in this agreement. Game equipment - a conventional gaming unit for participation in the game, called a "GAME DOLLAR," which is recorded and stored in the participant's electronic game account in the OVER GEMS accounting system. Game account - a virtual game participant's account, provided by the Organizer to each participant on the gaming platform for recording the "GAME DOLLAR" gaming equipment.
3. Definitions.
3.1. The subject of this Agreement is the provision by the Organizer to the participant of services for organizing leisure and health improvement in the game OVER GEMS in accordance with the terms of this Agreement. Such services include, but are not limited to, the following: services for the purchase and sale of gaming equipment (GAME DOLLAR), maintaining records of important information such as game account transactions, ensuring identification and security measures for participants, developing software integrated into the gaming platform and external applications, information and other services necessary for organizing the game and supporting the participant during it, and services on the organizer's website.
3.2. The game as a whole, as well as any of its elements or any associated external gaming application, are created solely for entertainment purposes. The participant acknowledges that all gameplay on the gaming platform is entertainment for them. The participant agrees that, depending on the characteristics of their account, the degree of their participation in the game will be available to them to varying degrees.
3.3. The Participant agrees to be personally responsible for all actions performed with the game inventory (GAME DOLLAR): purchases, sales, deposits, and withdrawals, as well as for gaming activities on the gaming platform: creation, purchases, sales, and transactions with all game elements and other game attributes and objects used for gameplay.
3.4. The Participant acknowledges that the extent and ability to participate in entertainment on the Game Server are fundamental qualities of the service provided to them.
4. Participant's Rights and Obligations.
4.1.1. Only persons who have attained legal capacity in accordance with the laws of their country of residence may participate in the game "OVER GEMS". All consequences of failure to comply with this requirement are borne by the Participant.
4.1.2. The extent and method of participation in the game are determined by the Participant, but may not conflict with this Agreement or the rules of the gaming platform.
4.1.3. The Participant is obliged to:
4.1.3.1. truthfully provide information about themselves upon registration and, upon the first request of the Organizer, provide reliable personal data that allows identification as the owner of the game account;
4.1.3.2. not use the game to commit any actions that are contrary to international law or the laws of the Participant's country of residence;
4.1.3.3. not use undocumented functions (bugs) and errors in the game software and immediately report them to the Organizer, as well as persons exploiting these errors;
4.1.3.4. not use any external programs for gaining advantages in the game;
4.1.3.5. Not to use your affiliate link or the resource containing it for advertising, mailing lists, or other types of messages to persons who have not consented to receive them (spam);
4.1.3.6. Not to restrict the access of other participants or other persons to the Game, and is obligated to treat other participants, as well as the Organizer, its partners, and employees, with respect and correctness, and not to interfere with the work of the latter;
4.1.3.7. Not to mislead the Organizer or game participants;
4.1.3.8. Not to use obscene language or insults in any form;
4.1.3.9. Not to defame the actions of other players or the Administration;
4.1.3.10. Not to threaten anyone with violence or physical harm;
4.1.3.11. Not distribute materials that promote rejection of or hatred toward any race, religion, culture, nation, people, language, politics, state, ideology, or social movement;
4.1.3.12. Not advertise pornography, drugs, or resources containing such information;
4.1.3.13. Not use actions, terminology, or jargon to disguise a violation of a participant's obligations;
4.1.3.14. To independently ensure the necessary computer and other security measures, to keep confidential and not to disclose to another person or another participant their identification data (login, account password, etc.), and to prevent unauthorized access to the email address specified in the participant's account profile. The participant bears the entire risk of any adverse consequences arising from the disclosure of this data, as the participant agrees that the gaming platform's information security system prevents the transfer of the participant's login, password, and account identification information to third parties;
4.1.3.15. Players are solely responsible for their financial transactions and operations. The Organizer is not responsible for financial transactions between players involving the transfer of game equipment, game currency, or other game attributes.
4.1.3.16. Be the first to notify the Organizer of any claims in writing via the help page.
4.1.3.17. Regularly review game news, as well as changes to this Agreement and the game rules on the gaming platform. The user is obligated to carefully READ the User Agreement and the description of the project's functions and services at least once a week, as ignorance of the rules does not relieve the user of liability for violating them.
4.2 Rights and Obligations of the Organizer.
4.2.1. The Organizer is obligated to:

4.2.1.2. Maintain records of the game inventory (GAME DOLLARS) in the participant's gaming account.
4.2.1.3. Regularly improve the hardware and software system, but does not guarantee that the gaming software is error-free or that the hardware will not exceed its operating parameters and will function without interruption.
4.2.1.4. Maintain confidentiality regarding the participant's personal data.
5. Warranties and Liability.
5.1. The Organizer does not guarantee continuous and uninterrupted access to the gaming platform and its services in the event of technical problems and/or unforeseen circumstances, including: malfunctioning or failure of internet providers, information servers, banking and payment systems, as well as illegal actions of third parties. The Organizer will make every effort to prevent interruptions, but is not responsible for temporary technical failures or interruptions in the Game, regardless of the cause.
5.2 The Participant fully agrees that the Organizer cannot be held liable for losses incurred by the Participant due to illegal actions by third parties aimed at violating the security system of the electronic equipment and game databases, or due to interruptions, suspensions, or terminations of communication channels and networks used for interaction with the Participant beyond the Organizer's control, as well as illegal or unjustified actions of payment systems or third parties.
